Overview

Welcome to the KickMap online store. The terms “we,” “us,” and “our” refer to KickMap.

KickMap operates this online store and related shopping services, including the information, content, features, tools, products, and services made available through the store (collectively, the “Services”). The KickMap online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced in them, describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They contain important information regarding your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you are otherwise legally authorized to enter into these Terms.

Adults purchasing KickMap products for youth players are responsible for the purchase and for appropriate supervision of the minor's use of the products.

To use certain Services or purchase products, you may be asked to provide information such as your email address, billing information, payment information, and shipping address. You represent that the information you provide is accurate, current, and complete and that you have the right to provide it.

If you create an account, you are responsible for maintaining the security of your account credentials and for activity occurring through your account.

Section 2 — Our Products

We make reasonable efforts to accurately describe and display our products. However, colors, dimensions, appearance, packaging, and other characteristics may appear differently depending on your device, display settings, photography, or manufacturing variations.

Product descriptions, availability, pricing, packaging, and specifications may change without notice.

We reserve the right to modify or discontinue products and to limit quantities available to any person, household, organization, geographic region, or jurisdiction where permitted by law.

KickMap Trainer™ is a training aid intended to assist with soccer ball-striking practice and development. Individual results will vary, and no particular athletic, competitive, or performance result is guaranteed.

Section 3 — Orders

When you place an order, you are making an offer to purchase. KickMap reserves the right to accept or decline an order where permitted by law.

An order is not considered accepted until payment has been successfully processed and we have confirmed the order.

Please review your order carefully before submitting it. Once an order enters fulfillment or has been mailed, we may be unable to change or cancel it.

If we decline, modify, or cancel an order, we will attempt to notify you using the contact information provided with your order.

Returns, refunds, and exchanges are governed by our Return & Refund Policy.

KickMap products may be purchased for personal, household, coaching, team, club, school, training, or other legitimate organizational uses. Products may not be purchased for unauthorized commercial resale, export, or redistribution without our permission.

Section 4 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice.

The price charged will be the price shown when the order is placed and reflected in your order confirmation.

Unless expressly stated otherwise, listed prices do not include applicable taxes or shipping charges.

You agree to provide accurate and current purchase, payment, and account information.

You represent that you are authorized to use the payment method submitted with an order and agree to pay all authorized charges associated with your purchase, including applicable shipping charges and taxes.

Section 5 — Shipping and Delivery

Physical-product orders are subject to our Shipping Policy.

Shipping and delivery dates are estimates and are not guaranteed. Delivery may be affected by USPS operations, weather, holidays, service interruptions, incorrect addresses, and other circumstances outside KickMap's reasonable control.

Some USPS mailing services used by KickMap may not provide end-to-end tracking. Tracking information therefore may not be available for every shipment.

Please ensure that the shipping address submitted with your order is complete and accurate.

Section 6 — Intellectual Property

The Services and their content, including trademarks, product names, logos, text, graphics, photographs, videos, designs, software, interfaces, training materials, product designs, and other content, are owned by or licensed to KickMap and may be protected by U.S. and international intellectual-property laws.

KickMap™, KickMap AI™, KickMap Trainer™, KickMap Coach™, associated logos, designs, product names, and other KickMap branding may not be used without authorization except as permitted by applicable law.

Unless expressly authorized, you may not reproduce, distribute, modify, republish, publicly display, commercially exploit, or create derivative works from materials provided through the Services.

Nothing in these Terms grants you ownership of or a license to KickMap intellectual property except for the limited right to use the Services and purchased products for their intended purposes.

Section 7 — Optional Tools

We may provide access to tools, services, or functionality offered by third parties.

We do not necessarily control these third-party tools and provide access to them on an “as is” and “as available” basis.

Your use of third-party tools may be governed by additional terms or policies established by those providers.

We may introduce additional features, tools, and resources in the future. Unless otherwise stated, those features will also be subject to these Terms.

Section 8 — Third-Party Links

The Services may contain links to websites, applications, or services operated by third parties.

KickMap is not responsible for the content, accuracy, availability, security, privacy practices, products, or services of third parties we do not control.

If you access a third-party website or service, you should review that provider's applicable terms and privacy practices.

Section 9 — Relationship with Shopify

The KickMap online store is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with KickMap.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and KickMap, including injury, damage, or loss resulting from purchased products or services.

You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made with KickMap to the extent permitted by applicable law.

Section 10 — Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our online store is powered by Shopify, Shopify also collects and processes certain personal information relating to your access to and use of the Services.

Section 11 — Feedback

If you voluntarily provide suggestions, ideas, reviews, proposals, comments, or other feedback regarding KickMap or the Services (“Feedback”), you grant KickMap a worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, display, and otherwise use that Feedback for legitimate business purposes.

You represent that you have the necessary rights to provide any Feedback you submit and that your Feedback does not violate the rights of another person or applicable law.

We are not obligated to compensate you for Feedback or to maintain Feedback in confidence unless we separately agree otherwise in writing.

Section 12 — Errors, Inaccuracies and Omissions

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, or other information.

We reserve the right to correct errors, update information, or cancel affected orders where permitted by law.

Section 13 — Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to violate applicable laws; infringe intellectual-property or privacy rights; transmit malicious software; commit fraud; impersonate another person; interfere with the operation or security of the Services; collect personal information about others without authorization; send spam or other unauthorized communications; or engage in conduct intended to harm KickMap, Shopify, our customers, or others.

You may not reproduce, scrape, systematically extract, sell, resell, or commercially exploit substantial portions of the Services without authorization.

We reserve the right to restrict or terminate access to the Services when we reasonably determine that these Terms have been violated.

Section 14 — Automated Agents

Automated or semi-automated software, agents, bots, crawlers, or similar technologies accessing the Services must comply with applicable laws, technical restrictions, and any instructions or access controls implemented by KickMap, Shopify, or our service providers.

Automated systems may not circumvent CAPTCHAs, security measures, access restrictions, rate limits, robot exclusions, or other technical measures designed to protect the Services.

We may restrict or block automated access where appropriate to protect the Services, customers, or our systems.

Section 15 — Termination

We may suspend or terminate access to some or all of the Services when permitted by law, including where these Terms have been violated.

Termination does not eliminate obligations or liabilities incurred before termination.

Provisions that by their nature should survive termination—including provisions relating to intellectual property, limitations of liability, indemnification, privacy, and governing law—will continue to apply.

Section 16 — Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” EXCEPT FOR WARRANTIES EXPRESSLY PROVIDED BY KICKMAP OR REQUIRED BY LAW.

KICKMAP DOES NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE.

KICKMAP PRODUCTS ARE TRAINING TOOLS. WE DO NOT GUARANTEE PARTICULAR ATHLETIC, PERFORMANCE, DEVELOPMENTAL, COMPETITIVE, RECRUITING, OR OTHER RESULTS FROM THEIR USE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

Section 17 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KICKMAP AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.

Section 18 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless KickMap, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your material violation of these Terms, violation of applicable law, infringement of another person's rights, or misuse of the Services.

Section 19 — Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed as necessary, without affecting the validity and enforceability of the remaining provisions.

Section 20 — Waiver; Entire Agreement

Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with the policies and other terms expressly incorporated into them, constitute the agreement between you and KickMap concerning your use of the Services and supersede prior agreements concerning the same subject matter.

Section 21 — Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or other legitimate business transaction, subject to applicable law.

Section 22 — Governing Law

These Terms and any dispute arising from or relating to the Services will be governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to applicable law, disputes arising from these Terms or the Services may be brought in courts of competent jurisdiction located in New Hampshire.

Section headings are provided for convenience only and do not limit or otherwise affect the interpretation of these Terms.

Section 24 — Changes to These Terms

We may update these Terms periodically to reflect changes to our Services, business practices, or legal requirements.

The current version will be posted on this page with an updated revision date. Where required by law, we will provide additional notice of material changes.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
